#LegalFeature: Immigration Questions and Answers

first_imgMIAMI, Florida –Question: Me and my husband went to my immigration appointment last month and even though the officer was not friendly, she said she had everything she needed for now and gave us a paper that said they couldnt make a decision and have 120 days to do it. The officer asked us for our lease, but we didn’t have one because we live with my sister, but we had a few other papers we brought showing our marriage documents like our current car insurance and joint bank account we got together last month that has a hundred bucks in it and tried to give it to her but she didn’t take it. She said it was strange that we don’t have a lease and live with my sister and asked us why we didn’t have utility bills there and we said it was because the house is in my sister’s name. I had 2 affidavits one from my aunt and one from my husbands mom, but she didn’t look at them either. Also my husbands driver license is from his old address. Now its been a month gone by and nothing. My husband called the immigration number and tried to make an appointment to go to the office where we had our interview to get a status but the immigration lady on the phone said no we have to wait for a decision. Now we are wondering what to do should we wait or what? Is there anything you can do to speed the process up?Answer: Sorry to hear that you didn’t have a pleasant experience, but it is very common these days to encounter USCIS officers who are seemingly applying stiffer standards in marriage immigration cases and are more skeptical about whether or not a marriage is real these days. The main issue in marriage-based immigration cases, is the critical necessity for a couple to clearly establish that the marriage is real – by providing extensive documentation from the time of the marriage until the interview, not just for the past month (for example Joint: lease, bank statements, driver’s license or state ID at the same address, auto insurance, utilities, both names on the lease, tax return “married filing jointly”, lots and lots of photos, etc. the list goes on and on. Affidavits attesting to a genuine marriage are usually not given much weight by an officer and are generally used as a last resort when a couple does not have enough other “real” documentary evidence to show. USCIS officers have a lot of discretion to decide whether a marriage is real or not, based upon the totality of all the evidence presented by the couple, as well as the way a couple presents themselves and especially the way they interact together at the immigration interview. There are many factors which immigration officers consider when making a determination about whether or not a marriage is real. Officers like to see lots of photographs of the couple with other people and family members at celebrations or events (not selfies), a joint lease or a home deed to show that one of the spouses owns the property and utilities from each spouse at the same marital address. Officers have a mental check off list of certain factors which tend to show a marriage is more real than not and the lack of these items tends to show that the marriage may be fake. High on the list of fake marriage “red flags” is a couple who does not have a joint lease and who instead live with relatives and do not have any utilities in their names. Similarly, spouse’s who’s driver’s licenses do not match the marital address cause heightened suspicion that a marriage is not real. Joint bank accounts are also important, but can also be a cause for concern. For instance, officers are looking for the couple to have joint bank accounts for a long period and to show that it is the only account both spouses use, deposit funds into and pay bills out of. Couples who open a joint account and put a $100 in which stays in every month looks more suspicious than anything else, leading to the belief that each spouse has their own separate account which they use, not the joint one. Especially since officers know that fake marriage partners do not trust each other enough to actually share a bank account. With all of that said, it is becoming more and more common in recent months for officers to issue notices to couples at the end of the interview which says that a decision cannot be made at this time and the officer has 120 days to make a decision. This just gives the officer time to adjudicate that case, perhaps have a supervisor review it and in many cases, issue an approval with a month or so. On the other hand, some couples often receive a Request For Evidence (RFE) to submit more marital documents, certified police reports and court dispositions for any criminal incidents or any other document the officer believes is missing to complete the case. In any event, if nothing is received within 90 days, it might be wise to contact your local congressional office to get assistance. This sometimes gets the case “out of the crack” and makes the officer either issue an RFE, schedule a second interview or approve the case. I hope this is helpful to you. Question: hi I got my green card from my parents about 8 years ago. I met my wife a few years ago and got married. She had came here on a student visa then overstayed for 3 years. We want to file her immigration papers but I heard that since I just have my green card she cant get her green card through me until I get my American citizenship. I filed my citizenship papers last month, but we know it takes a long time and we are wondering if  I can go ahead and file for her residency and work permit now even though im not a citizen to get her started, then later once I get my citizenship, she will be eligible. We just want to get her papers in and get her work permit since she has been waiting all these years. What do you think?Answer: No, not a good idea, since your wife must establish eligibility at the time the residency application (form I-485) is filed, not later during processing. If you were to mistakenly file her case now when she is not eligible, then to naturalize (become a U.S. Citizen) during the process, her application would not be approved, since you would have had to be a U.S. Citizen before she filed her adjustment of status application. The result would be that you would need to refile her application all over again, another $1,225 USCIS filing fees and likely even a referral to deportation. So be patient, wait until after you swear in as a citizen before filing for her residency. Question: my boyfriend is a green card holder since 2017 (through his aunt who filed for his parents). I recently came to the us to visit him and we heard through a friend that if we get married, I can stay here and file for my green card. We decided to do it, but I have a question about travelling. My sisters wedding is coming up in January and I need to go home to be a brides maid. If I file for my green card once we get married next week, will I be able to go home in January for the wedding?Answer: Good question. It is very important for immigrants who are filing for adjustment of status (residency) in the U.S. to understand that once the application is filed, they cannot leave the U.S. until they receive their travel permit, called “Advance Parole”. Under delayed Trump processing times, this is now often taking 6+ months to receive! If an immigrant leaves the U.S. after filing for adjustment, without the travel permit, the entire residency case is automatically cancelled. So, in your case, if your residency case is filed next week, it would likely take until May of next year to receive your work and travel permit. That means you will not be going home for the wedding. The other option is to leave the U.S. and come back for a visit after the wedding.last_img read more

How Much Insulation is Needed?

first_imgStandard residential construction in much of the country is 2×4 framing with fiberglass insulation, achieving a paltry R-10 or so in the walls. If insulation is installed at all on the foundation walls, it’s rarely more than an inch thick, and insulation is almost never put under slabs. In Vermont, we typically do a lot better. Act 250, enacted nearly four decades ago, required developers to improve energy performance and that led to a widespread switch to 2×6 framing in home building. But 2×6 wall construction is still woefully inadequate in my book. A well-built 2×6 frame wall insulated with dense-pack cellulose or fiberglass will achieve only about R-17 or R-18 (accounting for the “thermal bridging” through the more conductive wood studs). If we want to have a chance of achieving the carbon-emission-reduction goals that climate scientists tell us will be needed—80% reduction by 2050, or even sooner—we will have to start insulating houses much better. So what’s a reasonable target?Building science expert Joe Lstiburek, Ph.D., P.Eng., of Building Science Corporation in Westford, Massachusetts, argues that for any house north of the Mason-Dixon Line we should follow the “10-20-40-60 rule” for R-values: R-10 under foundation floor slabs; R-20 foundation walls; R-40 house walls, and R-60 ceilings or roofs.Getting to these insulation levels is a challenge, but it’s far from impossible. Here are a few ways in which the 10-20-40-60 insulation goals can be achieved:R-10 under concrete slabs. This can be achieved with 2″ of extruded polystyrene or XPS (for example, Dow Styrofoam), 2-1/2″ of high-density expanded polystyrene (EPS), or 2″ of spray polyurethane foam put in by a skilled insulation contractor. In cold climates like Vermont’s I think sub-slab insulation levels should be boosted even further—to about R-20, with 4″ of rigid foam.R-20 foundation walls. This can be achieved with either interior or exterior foundation insulation or with insulated concrete forms (ICFs). With exterior insulation, most common is XPS, but I’m a big fan of rigid mineral wool, such as Roxul Drainboard, which provides R-4.2 per inch and comes in thicknesses up to 2-3/8″ (so two layers of their thickest product will get you to the R-20 goal). If insulating on the interior, a reasonable approach is to add a 1″ or 2″ layer of rigid insulation against the foundation wall then add a 2×4 or 2×6 frame wall with cavity-fill cellulose or fiberglass insulation. With ICFs, many products are available with at least 2″ of high-density EPS on both the interior and exterior faces, so that the R-20 goal can be achieved fairly easily.R-40 above-grade house walls. Achieving R-40 in walls is a challenge. Here are several options that get you pretty close to that: a 2×6 frame wall with dense-pack cellulose plus three inches of foil-faced polyisocyanurate foam on the exterior; a double 2×4 wall separated by at least 3″ with the resultant cavity filled with dense-pack cellulose or high-density fiberglass batts (at least 10″ overall thickness); and a structural insulated panel (SIP) system with 9″ or 10″ panels.R-60 ceiling or roof. Such a high insulation level in the ceiling (unheated attic) can be achieved with 16″ to 18″ of cellulose insulation or high-density fiberglass batts—you may need somewhat more to achieve the recommended R-value after settling. If the roof is being insulated (above a cathedral ceiling), getting to R-60 will typically require a combination of cavity-fill insulation in the rafters or trusses and rigid insulation on top of the roof sheathing.Combining these insulation levels with a compact design, modest passive solar features, triple-glazed low-e windows, and high-efficiency lighting and appliances should get the energy consumption of new homes to less than a quarter that of standard new homes. The energy requirements for such homes should then be low enough that most, if not all, of the remaining energy needs could be satisfied (now or in the future) with photovoltaic (solar-electric) panels to achieve net-zero-energy or carbon-neutral performance.Over the coming weeks, I’ll examine various issues relating to extremely well-insulated houses as well as what can be done with existing houses—the concept of “deep-energy retrofits.”last_img read more

Video Tutorial: How To Get The Stranger Things Look

first_imgAvery Peck’s YouTube series of DaVinci Resolve color grading tutorials are just what you need to master this elusive post-production process.Cover image via Netflix/Kobal/REX/Shutterstock.Every so often, a new YouTube channel bursts out of nowhere that makes you ask “Why didn’t I think of this content first?” or “How did I ever get by without this channel?” (Thinking of you Every Frame a Painting — you will be missed.)There’s a noticeable lack of weekly, or even monthly, color grading tutorials. After all, the subject matter doesn’t necessarily involve creative visuals and clever editing transitions like a Peter Mckinnon video. More often, these tutorials are full of screen captures, and they’re pretty straightforward. (One of the best color grading tutorials in recent years came from Australian filmmaker Juan Melara, with his summer blockbuster grade tutorial.)At the time, it looked as if that tutorial was the first of many. Unfortunately, the series didn’t continue (right away), but as of October 2017, Juan has started to produce tutorials once more.I’ve recently stumbled across Avery Peck, who has just started to produce fun — and educational — DaVinci Resolve color grading tutorials. If there is one YouTube channel that I expect to grow exponentially, it would be this one.In his video, Avery goes into full detail about getting the look from the hit Netflix series Stranger Things. There’s always been a common misconception among online grading tutorials that you can achieve the “film-look” solely in post-production, regardless of the camera you shot with, and regardless of the original composition quality. Peck takes the grading tutorial a step further by first showing you the correct way to light the scene. For example, to mimic the exterior shots of Stranger Things, Peck says there are three elements to pay attention to: dynamic range, color palette, and separation. Both seasons were shot using RED cameras, and maximizing the dynamic range is an important part of getting the look. If you don’t have the luxury of shooting in RAW format, you can still do yourself a favor by shooting in LOG or in a Cinestyle profile.Another important element is the color palette. This is a consideration that needs pre-planning in conjunction with costuming, location, and production design. Peck notes that much of the palette consists of browns and teals, with red as an accent color. Therefore, if your subject is wearing a bright green T-shirt with purple paints, it’s not going to help when you start to grade for the specific look. These are just a few notes he touches upon before we even get into Resolve for the grading process. For the full low-down, check out the tutorial below. Looking for more on color grading? Steve Jobs & Guy Kawasaki — Powerpoint Best Practices

AddThis Sharing ButtonsShare to TwitterTwitterShare to FacebookFacebookShare to Email AppEmail AppShare to LinkedInLinkedInShare to MessengerMessengerShare to SlackSlack Presentations I have recently come across some interesting Powerpoint best practices that I thought I would share with you. Steve JobsThe first best practice was from watching Steve Jobs’ presentation at MacWorld this year.  What was fascinating about his slides is that they were either just a picture or just a picture with a couple of words in extremely large font.  It turns out that Steve wants the audience to listen to him tell the story, rather than read the slides. Here’s a picture of one of Steve’s slides:In contrast to Steve’s slide show, here’s a picture of a slide from Michael Dell.  Michael’s would work well if it were designed to be sent to someone who would not have the benefit of hearing the story live, but next to Steve’s slides, they just seem cluttered.Guy KawasakiI recently read Guy Kawasaki’s “Art of The Start.”  In addition to being a good author/blogger, Guy was one of the very early Apple employees and more recently has been a venture/angel investor type where he has listened to countless Powerpoint presentations.  Presumably because he is tired of seeing poor Powerpoint presentations, he spends many pages in his book talking about Powerpoint best practices.  There were a few nuggets of Powerpoint wisdom among a lot of content about it that stuck with me a few days after finishing the book. His mantra is that Powerpoint should follow a 10/20/30 Rule.  There should be no more than 10 slides in the presentation — very few people take away much more than one concept from a presentation, so all that other stuff is extra.  The slide presentation should be designed to last 20 minutes, leaving room for ample questions/discussion between slides or after the presentation.  Guy points out that the point of the presentation is typically to initiate a discussion.  He says the font should be size should be no smaller than 30 (Arial font).  Guy says that audiences read faster than you can talk, so that while you are up there talking, they are trying to read your slides and not listening to what you are saying. He says that there are something like 60 animation features within Powerpoint and he recommends the less use of it the better.  His advice is to use your voice/body to emphasize when a point is important, not some fancy Powerpoint trick.  The only place he recommends using any of this is in going through bullet points on a slide, presumably to avoid having people read ahead.  Speaking of bullets, Guy suggests that bulleted slides should have one point with bullets and only one layer of bullets (lest you violate the 30 part of 10/20/30).If you have some great Powerpoint tips, please do share them with us…– Brian Halligan.last_img read more
